Silence Equals Consent: What Changes for Building Permits in 2026

An administrative revolution is brewing. From 2026, the “silence equals consent” principle will apply to certain building permit applications in Luxembourg. No more endless waiting without response.

The Silence Equals Consent Principle

Currently, a building permit application without response from the administration remains pending indefinitely. You have to follow up, wait, and sometimes the file drags on for months.

With the new principle, if the administration doesn’t respond within a defined deadline, your application is automatically approved. The administration’s silence equals consent.

Projects Concerned

Silence equals consent won’t apply to all projects. Only certain categories are affected.

Light works such as window replacement with change of appearance, small extensions under 20m², and simple external landscaping will be eligible.

Works in protected zones, major new constructions and projects requiring impact studies remain subject to the classic procedure with mandatory response.

Deadlines to Respect

The administration’s response deadline will be set according to project type.

For light works, the deadline will be 2 months. Without response from the municipality within this deadline, authorisation is deemed granted.

For larger projects still eligible for silence equals consent, the deadline may extend to 4 months.

Important: The deadline only runs from submission of a complete file. If documents are missing, the counter doesn’t start.

How to Prove Tacit Consent

In case of silence equals consent, you’ll need to prove that your application was indeed submitted and the deadline has expired.

The submission receipt with date is essential. Keep it carefully.

A tacit consent certificate can be requested from the municipality after the deadline expires.

This certificate will be necessary for subsequent procedures, particularly with insurers and banks.

What Doesn’t Change

Certain rules remain unchanged despite this development.

The file must still comply with your municipality’s PAG (General Development Plan) urban planning rules. Tacit consent on a non-compliant project could be annulled.

Third party appeals remain possible. A neighbour can still contest a project, even if approved by silence.

Inspections during and after works are maintained. Tacit consent doesn’t exempt you from following the rules.

Prepare a complete and compliant file now. An incomplete file will delay the start of the deadline.

Verify your project’s compliance with your municipality’s PAG. A non-compliant project will be refused, even with silence equals consent.
