1. Acceptance of Terms
By accessing and using the tack.lu platform ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not accept these terms, you must not use our Service.
2. Description of Service
Tack.lu is a platform connecting property owners seeking craftsman services with qualified professionals in Luxembourg. We facilitate the connection but do not act as a contractor for the work performed.
3. Types of Users
3.1 Property Owners (Clients)
- Individuals or legal entities seeking craftsman services
- Must be at least 18 years old
- Submit quote requests for free
- Can select up to 3 craftsmen per project
3.2 Craftsmen (Professionals)
- Businesses or self-employed registered in Luxembourg
- Must provide a valid VAT number
- Pay to access client contact information
- Commit to providing quality services
4. Registration and Account
4.1 Account Creation
To use certain features, you must create an account by providing:
- Accurate and complete information
- A valid email address
- A secure password
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your credentials
- All activity under your account
- Notifying us immediately of any unauthorized access
5. Use of Service
5.1 Permitted Uses
- Search for or offer legitimate craftsman services
- Communicate professionally and respectfully
- Provide truthful information
5.2 Prohibited Uses
It is prohibited to:
- Use the Service for illegal or fraudulent purposes
- Impersonate others
- Harass, threaten, or defame other users
- Post offensive, discriminatory, or inappropriate content
- Spam or send unsolicited communications
- Circumvent Service fees
- Extract data automatically (scraping)
- Compromise the security or operation of the Service
6. Connection Process
6.1 For Property Owners
- Free submission of quote requests
- Receive notifications from interested craftsmen
- Select up to 3 craftsmen
- Automatic transmission of contact details to selected craftsmen
6.2 For Craftsmen
- View requests in their area and specialty
- Express interest in relevant projects
- Automatic payment if selected by the client
- Receive client contact details after payment
7. Pricing and Payment
7.1 Pricing Structure
- Property owners use the Service for free
- Craftsmen pay for each lead obtained
- Prices vary according to service type and project size
- Rates are displayed before expressing interest
7.2 Payment
- Payment is processed automatically via Stripe
- Craftsmen must set up a valid payment method
- Payment is charged only if selected by the client
- Fees are non-refundable except in exceptional cases
7.3 Refund Policy
A refund may be granted if:
- Client information is incorrect or fraudulent
- Client does not respond within 7 days
- A technical error on our part
8. Intellectual Property
8.1 Our Content
All content on tack.lu (logo, text, design, code) is protected by copyright and belongs to Tack.lu or its licensors.
8.2 Your Content
By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Service.
9. Liability and Warranties
9.1 Role as Intermediary
Tack.lu acts solely as an intermediary. We are not a party to contracts between property owners and craftsmen.
9.2 Limitation of Liability
To the extent permitted by law, Tack.lu cannot be held liable for:
- The quality of work performed
- Disputes between property owners and craftsmen
- Indirect or consequential losses
- Temporary unavailability of the Service
9.3 Warranties
The Service is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the Service will meet all your needs or be error-free.
10. Indemnification
You agree to indemnify and hold Tack.lu harmless from any claims resulting from:
- Your use of the Service
- Your violation of these Terms
- Your violation of third-party rights
- Your interactions with other users
11. Dispute Resolution
11.1 Mediation
In case of dispute with another user, we encourage amicable resolution. We may facilitate mediation but are not obligated to do so.
11.2 Disputes with Tack.lu
Any dispute with Tack.lu will be subject to Luxembourg law and the competent courts of Luxembourg.
12. Termination
12.1 By You
You may close your account at any time by contacting us. Existing contractual obligations remain in effect.
12.2 By Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal behavior
- You harm other users or the Service
13. Modifications to Terms
We may modify these Terms at any time. Significant changes will be notified by email. Continued use of the Service after modification constitutes acceptance.
14. General Provisions
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Tack.lu regarding use of the Service.
14.2 Severability
If any provision is found invalid, the remaining provisions remain in effect.
14.3 Non-Waiver
Failure to exercise a right does not constitute a waiver of that right.
